Last updated: 29 August 2026
About these terms
These Terms govern your use of this website and any publishing, editing, ghostwriting, design or marketing services (the “Services”) provided by Kimberley Design & Publishing Limited, registered in England and Wales, company number 17422144, registered office Star Lodge, Montpellier Drive, Cheltenham, GL50 1TY, United Kingdom, trading as Kimberley Direct Publishing (“we”, “us”, “our”). By using the site, submitting an enquiry or engaging our Services, you agree to these Terms.
Our services
We provide book publishing support services, which may include manuscript assessment, ghostwriting, editing and proofreading, cover and interior design, formatting, ISBN assignment and publishing set-up, distribution, marketing and author website creation. The services in any engagement are set out in a separate quote, invoice or service agreement (an “Order”).
Quotes, orders and pricing
- All prices are given as a personalised quote based on your project’s scope, length and requirements.
- A quote is valid for the period stated in it, or 14 days if no period is stated.
- An Order is confirmed once you accept a quote and, where applicable, pay the required deposit.
- We may amend pricing for additional work not covered in the original scope, such as major manuscript changes or extra revision rounds.
Payment terms
We accept Visa, Mastercard, American Express, bank transfer, Apple Pay, Stripe and PayPal.
Unless otherwise agreed in writing, the required deposit is paid before work begins. If you cancel, we may deduct from the deposit the value of work performed and costs incurred or committed up to the cancellation date, and refund any remaining balance.
We may pause work on any project where payment is overdue. Prices are in the currency stated on your invoice and exclude applicable taxes unless stated otherwise.
Cancellations and refunds
- You may cancel your Order at any time by telling us in writing.
- Any deposit paid is refundable, less the cost of work already completed.
- If you cancel after work has begun, you are charged for work completed up to that point, on a pro-rata basis.
- Refunds are processed within 14 business days to the original payment method.
This does not affect your statutory rights under the Consumer Rights Act 2015.
Manuscripts and your responsibilities
By sending us material, you confirm that you are the author or hold the necessary rights, that it does not infringe anyone else’s intellectual property, and that it contains nothing unlawful or defamatory. Delays in your feedback may affect delivery timelines.
Intellectual property and ownership
- You keep full ownership of the copyright in your manuscript and the finished book at all times.
- You keep 100% of your royalties from sales, unless a different arrangement is separately agreed in writing.
- Covers, illustrations and formatted interiors created for your project are licensed to you for the publication and sale of your book once paid for in full. We may display them in our portfolio, as below.
- We claim no ownership of your story, ideas or manuscript content.
Portfolio, testimonials and marketing use
Unless you tell us otherwise in writing, we may feature your book cover, title, genre and a brief description in our portfolio and marketing, and testimonials you provide, attributed as you specify. You can opt out at any time by emailing info@kimberleydirectpublishing.com.
Delivery timelines
Timelines are estimates given in good faith, not guarantees. They depend on the manuscript’s condition, the scope of work and the speed of your feedback.
Third-party platforms
Publishing, distribution and printing may involve third-party platforms such as Amazon KDP, IngramSpark, Apple Books, Barnes & Noble and Lulu. We are not responsible for their policies, availability, pricing or service interruptions.
Limitation of liability
- We provide our Services with reasonable skill and care, but we do not guarantee any sales, royalty income, reviews or commercial success.
- To the fullest extent permitted by law, our total liability for any Order is limited to the amount you paid for that Order.
- We are not liable for indirect or consequential losses.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under English law.
Confidentiality
We treat manuscripts and project materials as confidential and share them only with the people and platforms directly involved in your project, or as required by law.
Termination and force majeure
We may suspend or end an Order if payment is not received, if submitted material is unlawful or infringing, or if performance becomes impossible for reasons outside our reasonable control. We are not liable for delays caused by events beyond our reasonable control.
Governing law
These Terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction.
